Court drops criminal charge against David Daleiden

A Texas court is dropping a misdemeanor criminal charge against David Daleiden, the undercover investigator who exposed Planned Parenthood's traffic in aborted babies' body parts.

The misdemeanor charge accused Daleiden of "unlawfully, intentionally and knowingly offer[ing] to buy human organs, namely, fetal tissue, for valuable consideration" when he presented himself as a buyer for a fake tissue procurement company in his undercover videos.

In an order issued Monday, the Harris County Criminal Court dismissed the indictment for lack of jurisdiction based on a defective and void indictment.

In a press release issued Tuesday, Peter Breen, special counsel for the Thomas More Society, which is representing Daleiden, said, "The Harris County prosecutors were in such a rush to criminalize David Daleiden that they did not properly obtain grand jury approval of each of the elements of the charged misdemeanor."

"All charges against Daleiden and his investigators should be dismissed," Breen continued, "based on the evidence that Harris County District Attorney's prosecutors colluded with Planned Parenthood to secure these indictments."

He added, "Planned Parenthood's illegitimate aim is clear: it hopes to turn attention away from the abortion industry's baby parts trafficking, by instead attacking the man who exposed its illegal practices."

The felony charge of tampering with a government document (Daleiden had used fake IDs during his undercover investigation) remains and is pending before the court.

Daleiden's Center for Medical Progress issued a statement responding to the court's actions:

Judge Diane Bull's swift dismissal of the bogus charge against CMP founder David Daleiden of trafficking human organs is the latest confirmation that the indictments from a runaway grand jury in Houston were a politically motivated sham all along. In finding that the indictment was void on its face, Judge Bull's ruling directly contradicts the District Attorney’s argument that the indictment was valid despite the DA's collusion with Planned Parenthood. The dismissal of the first indictment today sends a strong message to Planned Parenthood and their political cronies that colluding to suppress the First Amendment rights of citizen journalists will never work.

Daleiden published a series of videos last summer and fall showing that Planned Parenthood profits off the traffic of aborted fetal body parts. Following the published footage, multiple states yanked funding from the abortion giant in their states and initiated criminal investigations into their practices.

The U.S. Congress also formed a panel to investigate Planned Parenthood, recently issuing documents proving that the abortion giant's traffic in body parts results in "pure profit," contrary to Planned Parenthood's claims. The investigation also showed that the abortion giant is violating medical privacy laws by allowing outside tissue procurement companies to illegally examine patients' files in order to determine gestational ages of unborn children so they can single out in advance which organs or limbs should be taken from which aborted babies.
